Terms of Service

The Services are offered exclusively to customers receiving delivery within the twenty-five (25) ZIP codes listed on our Service Area page. Orders submitted from a delivery address outside that area cannot be accepted and will be cancelled without charge. By placing an order you represent that you are at least eighteen (18) years of age and legally able to enter into this agreement.

The per-gallon price and any volume or cash discounts you qualify for at the moment you submit an order are recorded together with a timestamp at submission (the “Price Lock”) and stored in our records. The Price Lock remains in effect through delivery, regardless of subsequent changes to our posted rate or discount configuration. Volume discounts (the qualifying gallon amount is shown with your quote) and cash discounts, when applicable, stack.

Your final charge is calculated by multiplying the actual gallons delivered by your locked net per-gallon rate, plus any applicable sales tax. This applies to both fixed-quantity orders and Fill Up orders. If actual gallons delivered are less than the quantity ordered (for example, because your tank filled before reaching the ordered amount), you are billed only for gallons actually delivered. If you request a larger delivery during the confirmation call, additional gallons beyond the ordered quantity may be priced at the rate in effect at the time of that change.

Pay by card over the phone, Zelle, check, or cash. No card numbers are stored on our website. For card and Zelle payments, payment details are collected by our staff over the phone during the confirmation call following order submission. Payment is due on delivery unless otherwise agreed in writing.

Returned checks and chargebacks initiated without prior written notice will be subject to a thirty-five dollar ($35) processing fee in addition to the outstanding balance.

You may cancel an order at no charge at any time before the truck has been dispatched to your address. To cancel, call (914) 483-6860 or reply to your order confirmation email. Once the truck has been dispatched, the order may be subject to a trip charge equal to the lesser of seventy-five dollars ($75) or twenty percent (20%) of the order total.

Refunds for paid orders are processed to the original payment method within five (5) business days of cancellation.

Residential heating oil is exempt from New York State sales tax. Putnam County applies 0% local sales tax on residential heating oil. Westchester County applies a 4% local sales tax on residential heating oil. Commercial deliveries are taxed at the standard combined state and local rate. Applicable sales tax depends on the delivery address and whether the property is residential or commercial. Where tax is not fully calculated at the time of order submission, the total shown to you at submission is an estimated order total; the final amount due, including any applicable tax, is confirmed on your delivery receipt. By selecting “Residential” at order, you affirm under penalty of perjury that the oil is for residential use at the delivery address, as required by New York Tax Law and 20 NYCRR § 528.7.

Delivery is governed by our separate Delivery Policy, which is incorporated into these Terms by reference. We are not liable for delays caused by weather, road conditions, equipment failure, supplier shortage, or other circumstances outside our reasonable control.

You represent that the heating oil tank at the delivery address is in good working order, properly vented, and capable of receiving the gallons ordered. We inspect the fill cap and external visible portion of the tank only. We are not responsible for internal tank conditions, internal corrosion, or pre-existing leaks not visible from the exterior. You are responsible for maintaining a clear, passable path from the street to the fill cap.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to your use of the Services or any single delivery is limited to the amount actually paid by you for the order in question. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or property damage not directly caused by our equipment or personnel.

You agree to defend, indemnify, and hold harmless Prestige Oil Inc., its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misrepresentation regarding tank condition or residential use, or your violation of any law.

The Site, including all text, graphics, logos, photographs, and software, is owned by Prestige Oil Inc. or its licensors and is protected by United States copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.

We may revise these Terms at any time by posting an updated version on the Site. The version in effect at the time you submit an order governs that order. Continued use of the Services after a revision constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Putnam County, New York, and you consent to personal jurisdiction in those courts.

If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and Delivery Policy, constitute the entire agreement between you and Prestige Oil Inc. regarding your use of the Services.
